Welcome to Peak Fantasy Realm. By accessing or using our website at peakfantasyrealm.com (the "Site") and our fantasy sports platform (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use our Service.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

2. Eligibility Requirements

Age Requirement: You must be at least 18 years of age to create an account and participate in contests on Peak Fantasy Realm.

Location Restrictions: Our Service may not be available in all jurisdictions. You are responsible for ensuring that your use of the Service complies with all applicable local laws and regulations.

Account Verification: We reserve the right to verify your age and identity at any time. Failure to provide requested verification may result in account suspension or termination.

3. Account Registration

To use our Service, you must create an account by providing accurate and complete information. You agree to:

• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You may not create an account if you have been previously banned from the Service. One person may maintain only one account.

4. Fantasy Sports Contests

Contest Rules: Each contest is governed by specific rules regarding scoring, lineup construction, and player selection. You are responsible for understanding and following all contest rules before entry.

Skill-Based Competition: Peak Fantasy Realm offers skill-based fantasy sports contests where success is determined by participants' knowledge of Baseball and strategic decision-making.

Lineup Submission: All lineups must be submitted before the designated contest lock time. Late submissions will not be accepted. Once a contest locks, lineups cannot be modified.

Scoring: Points are awarded based on real-world Baseball player statistics according to our published scoring system. See our Point System page for detailed scoring rules.

5. User Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Create multiple accounts or share accounts with others
• Use automated systems or bots to access the Service
• Attempt to manipulate contests or exploit system vulnerabilities
• Harass, abuse, or harm other users
• Reverse engineer or attempt to extract source code
• Collect or harvest information about other users
• Transmit viruses, malware, or other malicious code

Violation of these terms may result in immediate account termination and forfeiture of any account balance.

6. Intellectual Property

All content on the Site, including text, graphics, logos, images, software, and data compilations, is the property of Peak Fantasy Realm or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

7. Third-Party Services

Our Service may integrate with or contain links to third-party websites, applications, or services. We are not responsible for the content, privacy practices, or terms of service of any third parties. Your use of third-party services is at your own risk.

• Statistical data provided will be free from inaccuracies

We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEAK FANTASY REALM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the past twelve months, or $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Peak Fantasy Realm, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

11. Contest Cancellations and Modifications

We reserve the right to cancel, suspend, or modify contests due to unforeseen circumstances, including but not limited to:

• Game postponements, cancellations, or rescheduling
• Technical difficulties or system errors
• Suspected fraud or rule violations
• Natural disasters or force majeure events

In the event of a cancellation, affected entries will be refunded according to our refund policy.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class actions or class arbitrations.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Peak Fantasy Realm is registered, without regard to conflict of law principles.

13. Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent activity or suspected fraud
• Failure to verify your identity or age
• Creating multiple accounts
• Abusive behavior toward other users or staff

You may close your account at any time by contacting customer support. Upon termination, your right to use the Service will immediately cease.

14. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely matches the intent of the original provision.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Peak Fantasy Realm regarding the Service and supersede all prior agreements and understandings.
